Buying an air conditioner and obtaining installation approval are separate matters. A split system involves outdoor-unit mounting, wall penetrations, the facade, noise and condensate disposal. There is no blanket balcony exemption. The building, mounting method and heritage status determine the process. Prepare an installation proposal before checking approvals.
If you are a tenant
Civil Code §694 requires landlord consent for building alterations and other substantial apartment changes, even at your expense. Obtain written approval for the actual layout, holes, power supply and drainage. Agree ownership, servicing, removal and wall restoration at departure. An agent’s assurance does not replace the owner’s consent.
Building management and owners’ approval
The facade and other shared parts are not your private mounting surface. Act 182/1993 §11(4) restricts changes to appearance without owners’ consent; §14b governs voting, including interventions in shared parts. Matters under §14b(1) require a majority of all owners, but check the work category and building rules. Signatures from immediate neighbours alone may not replace a valid decision.
Ask the správca or spoločenstvo for current rules and any standing approval: some buildings already prescribe locations, mounts and installation requirements. Check insulation warranties and sealing of penetrations. A unit inside a loggia can still affect shared parts, neighbours and require drilling; its location alone does not decide approval requirements.
Building authority: the post-2025 framework
The new Building Act 25/2025 applies from 1 April 2025, subject to transitional rules. At review, the version effective from 1 November 2025 applies; a future 2027 version is not current law. Not every installation has the same classification. Send the local stavebný úrad the address, facade photos, mounting and pipe layout, structural intervention details and unit specifications. Ask whether notification or another procedure is required.
Where notification is required, §63 provides for documentation and relevant opinions. An installer’s verbal assurance does not complete the process. Owners’ approval does not replace building requirements, and the building procedure does not grant use of others’ shared property. Obtain the necessary documents and confirm commencement conditions before irreversible work.
Heritage buildings and protected areas
Act 49/2002 §32 requires a prior heritage decision for changes to a monument and for alterations to non-monument buildings in a heritage area; protective zones can require a binding opinion. The building’s own monument designation is not the only factor. Check the address with Pamiatkový úrad and discuss visibility, piping and alternative locations with the regional KPÚ. A building-notification exemption does not remove heritage requirements.
Noise, drainage and the installation brief
- Compare the outdoor unit’s acoustic specifications, including night mode. A datasheet figure is not the noise at a neighbour’s window: distance, reflections and vibration matter.
- Specify suitable anti-vibration mounts and safe service access.
- Agree drainage that does not drip onto neighbours’ windows, the facade or pedestrians; consider winter heating and defrost water separately.
- Obtain an itemised quotation covering mounts, piping, electrical work, sealing, commissioning and warranty, rather than only the appliance price.
Noise limits under Regulation 549/2007 depend on location, time and source category. Advertised decibels alone cannot establish compliance. Keep a operating-time log and conditions record for noise disputes and contact the relevant RÚVZ. Legally relevant assessment differs from a phone app reading. Find the office through the official ÚVZ SR portal.
Before placing an order
A practical sequence: technical layout → landlord consent → building rules and owners’ decision → building procedure and heritage checks where applicable → final quotation and approved installation. If a tenant cannot install a split system, discuss a portable device without permanent alterations, checking noise, exhaust and safe window sealing. This is an option to discuss, not a promise of equivalent performance.
